Three 9th Circuit Court of Appeals judges appeared skeptical of arguments by attorneys for Kalshi and two other prediction markets that Nevada gaming regulators are unfairly keeping the businesses out of the state.

During a more than two-hour hearing in San Francisco involving the Nevada Gaming Control Board's lawsuits against Kalshi and two other prediction market operators, Crypto.com and Robinhood Derivatives, the judges sought to distinguish the business differences from Nevada's regulated sportsbooks and the companies that are regulated federally by the federal Commodity Futures Trading Commission (CFTC).

"Explain to me the difference between a sports bet that happens in Caesars and a sports bet with [a prediction market]?" Judge Ryan Nelson asked an attorney for Crypto.com. "The waters have been muddied, but that happens all the time."

Judge Bridget Shelton Bade, who is based in Phoenix, remarked that Kalshi seems to be advertising heavily in her home state.

"I think I see one of these ads almost every day on my phone," Bade said. "It's a lost cause. I don't care about sports. So you can tell them to stop sending them to me, but it seems like they are advertising this as sports betting."

During the hearing, when a national reporter speculated on social media that the hearing wasn't going well for prediction markets, Florida-based gaming attorney and legal analyst Daniel Wallach wrote on X that it was the "understatement of the year."

In a separate case last week involving New Jersey, the 3rd Circuit Court of Appeals ruled 2-1 in favor of Kalshi, which could prevent the state from regulating the prediction market. More than 20 states have various legal challenges involving prediction market companies.

Analysts believe the matter will ultimately be decided by the U.S. Supreme Court.

Nelson, who is from Idaho Falls, Idaho, and oversaw the hearing, said the judges would quickly make a ruling.

Nicole Saharsky, an attorney with Mayer Brown in Washington, D.C., who represented Nevada gaming regulators, said the cases brought before the court constitute "a severe intrusion on state sovereignty. Their position is that all sports bets would qualify as swaps. That would make the CFTC the nation's gaming regulator."

Saharsky said the challenges to state gaming laws would effectively nullify the 2018 U.S. Supreme Court ruling that allowed individual states to legalize sports betting.

"The Supreme Court was very clear. It's the states that get to make the decisions on gaming," Saharsky said.

Nelson suggested the prediction market efforts could be "a sea change" for Nevada's gaming industry.

"It would be a huge deal. It would take away the power from the states," he said.

Two of the prediction markets, Crypto and Robinhood, voluntarily agreed to cease and desist orders issued by Nevada regulators, to allow the legal proceedings to play out.

In March, Carson City District Court Judge Jason Woodbury issued a temporary ban on Kalshi from operating in Nevada, which is set to expire on Friday. Jessica Whelan, chief deputy solicitor general for the Nevada Attorney General's Office, said the state and Kalshi agreed to extend the ban for another week while the sides work out the language for a longer ban.

An attorney for Kalshi told the court that Nevada's actions to block the company from operating put the prediction market in violation of the CFTC's impartial access, which requires offering the same product nationwide.

Journey of Reconciliation

On April 10, 1947, CORE sent a group of eight white men, including James Peck, their publicity officer, and eight black men, on what was to be a two-week Journey of Reconciliation through Virginia, North Carolina, Tennessee, and Kentucky, to test state’s compliance with the Supreme Court’s decisions regarding segregation within interstate travel.[16][17]

The group was composed of men only, to get around certain laws of the time that restricted the mixing of males and females.[18] These participants then underwent rigorous training aimed at equipping them with the necessary skills to react non-violently, even in the face of violent behaviors. They would act out intense role-playing exercises to simulate real-life scenarios they may encounter, in an attempt to improve their resolve in the face of violence. Throughout the two-week period, they completed twenty-six demonstrations on buses or trains.[18] Out of these twenty-six demonstrations, six resulted in arrests. The members of this group received a great deal of publicity, and this marked the beginning of a long series of similar campaigns.[18]

After 75 years the North Carolina court vacated the convictions of four freedom fighters from the Journey of Reconciliation.[19] Renee Price, chair of the Orange County Board of Commissioners, learned that the charges against these men arrested in Chapel Hill had never been dropped. "They were arrested and convicted for violating laws that were in fact a violation to humanity, a violation to human dignity and a violation to freedom and justice for all," said Price. She reached out to Orange County Superior Court Judge Allen Baddour, whose office researched the incident and legal cases. On June 17, 2022, Superior Court Judge Allen Baddour vacated and dismissed the charges in a Special Court Session which drew over 100 people into the very courtroom where the men were sentenced.

The First "Freedom Ride"

In the early 1960's, James Farmer resumed his position as executive secretary of CORE, with the objective of replicating the 1947 Journey of Reconciliation, only this time under a new name - the Freedom Ride.[18]

On May 4, 1961, male and female participants started their journey through the deep South, testing segregated bus terminals as well. The riders were met with severe violence. In Anniston, Alabama, one of the buses was fire-bombed and passengers were beaten by a white mob. White mobs also attacked Freedom Riders in Birmingham and Montgomery.[20] The violence garnered national attention, sparking a summer of similar rides by CORE, the Student Nonviolent Coordinating Committee and other civil rights organizations and thousands of ordinary citizens.[21]

MEMORANDUM OF POINTS AND AUTHORITIES

CASE HISTORY

A Criminal Complaint was filed on August 7, 2025, charging the Defendant with Violation

of an Extended Order Against Staking or Harassment, a Category C Felony.

Counsel was appointed to represent the Defendant in the above-mentioned matter. On or about October 15, 2025, the Defendant's matter was transferred from the Dayton Justice Court to

the Canal Justice Court following the entry of the Recusal and Order of Appointment. The

Defendant appeared before the Canal Justice Court on October 28, 2025. The Defendant appeared

before the Canal Justice Court for a Status Hearing on or about December 16, 2025, and the matter 10 was bound over to the District Court for Competency Proceedings.

The Defendant has been seen before the District Court on January 5, 2026, January 26,

12 2026, February 9, 2026, and March 2, 2026. The Defendant has been deemed incompetent and a

13 recommendation for outpatient treatment has been made by providers.

13 And now come I to thee, and these things speak I in the world, that they might have my joy fulfilled in themselves.

14 I have given them thy word, and the world hath hated them, because they are not of the world, as I am not of the world.

15 [i]I pray not that thou shouldest take them out of the world, but that thou keep them from evil.

16 They are not of the world, as I am not of the world.

17 [j]Sanctify them with thy truth: thy word is truth.

18 [k]As thou didst send me into the world, so have I sent them into the world.

19 And for their sakes sanctify I myself, that they also may be sanctified through the [l]truth.

20 [m]I pray not for these alone, but for them also which shall believe in me, through their word,

21 That they all may be one, as thou, O Father, art in me, and I in thee: even that they may be also one in us, that the world may believe that thou hast sent me.

22 And the glory that thou gavest me, I have given them, that they may be one, as we are one,

23 I in them, and thou in me, that they may be made perfect in one, and that the world may know that thou hast sent me, and hast loved them as thou hast loved me.

24 Father, I will that they which thou hast given me, be with me even where I am, that they may behold that my glory, which thou hast given me: for thou lovedst me before the foundation of the world.

25 O righteous Father, the world also hath not known thee, but I have known thee, and these have known, that thou hast sent me.

26 [n]And I have declared unto them thy Name, and will declare it, that the love wherewith thou hast loved me, may be in them, and I in them.

John 17:1 Jesus Christ the everlasting high Priest being ready straightway to offer up himself, doth by solemn prayers consecrate himself to God the Father as a sacrifice: and us together with himself. Therefore this prayer was from the beginning, is, and shall be to the end of the world, the foundation and ground of the Church of God.

John 17:1 He first declareth, that as he came into the world to the end that the Father might show in him, being apprehended by faith, his glory in saving his elect, so he applied himself to that only: and therefore desireth of the Father, that he would bless the work which he hath finished.

John 17:3 He calleth the Father the only very God, to set him against all false gods, and not to shut out himself and the holy Ghost, For straightway he joineth the knowledge of the Father and the knowledge of himself together, and according to his accustomed manner, setteth forth the whole Godhead in the person of the father: So is the Father alone said to be King, immortal, wise, and dwelling in the light which no man can attain unto, invisible, Rom. 16:17; 1 Tim. 1:17.

John 17:6 First of all he prayeth for those his disciples, by whom he would have the rest to be gathered together, commendeth them unto the Father, (having once rejected the whole company of the reprobate) because he received them of him into his custody, and for that they embracing his doctrine, shall have so many and so mighty enemies, that there is no way for them to be in safety, but by his help only.

John 17:6 He showeth hereby that everlasting election and choice, which was hidden in the good will and pleasure of God, which is the groundwork of our salvation.

John 17:6 He showeth how the everlasting and hidden purpose of God is declared in Christ, by whom we are justified and sanctified, if we lay hold of him by faith, that at length we may come to the glory of the election.

John 17:18 He addeth moreover, that the Apostles have a vocation common with him, and therefore that they must be holden up by the selfsame virtue to give up themselves wholly to God, whereby he being first, did consecrate himself to the Father.

John 17:19 The true and substantial sanctification of Christ, is set against the outward purifyings.

John 17:20 Secondarily he offereth to God the Father, all his, that is, how many soever shall believe in him by the doctrine of the Apostles: that as he cleaveth unto the Father receiving from him all fullness, so they being joined with him, may receive life from him, and at length being together beloved in him, may also with him enjoy everlasting glory.

John 17:26 He communicateth with his by little and little, the knowledge of the Father, which is most full in Christ the Mediator, that they may in him be beloved of the Father, with the selfsame love wherewith he loveth the Son.
