A three-judge panel of the Ninth Circuit Court of Appeals is deciding whether to uphold U.S. District Judge David Campbell’s disqualification of Acting U.S. Attorney Sigal Chattah’s participation in prosecutions, and whether Campbell erred by not dismissing criminal indictments prosecuted by Chattah in her acting role.

The hearing comes a day after President Donald Trump appointed Las Vegas attorney George Kelesis to the post, pending Senate confirmation.

The “hearing was not moot,” Chattah said via text. She did not respond when asked if she intended to remain in the office as first assistant U.S. attorney, a title she adopted after Campbell disqualified her from supervising prosecutors.

Attorney General Pam Bondi appointed Chattah in March 2025 as interim U.S. attorney for a 120-day term that expired July 29 of last year. Chattah resigned just before the expiration to take the position of first assistant, triggering a provision of the Vacancies Reform Act of 1998 which the administration contends allowed Trump to name her acting U.S. attorney, giving Chattah another 210 days on the job, ostensibly to allow time for Senate confirmation. Chattah’s nomination, however, has never been forwarded to Congress.

Nevada’s Democratic U.S. Sens Catherine Cortez Masto and Sen. Jacky Rosen voiced vehement opposition to the selection of Chattah, known as a Republican firebrand Trump loyalist.

“U.S. Attorney for Nevada is a critical position, and Senator Cortez Masto plans to conduct a tough, thorough interview with Mr. Kelesis,” Lauren Wodarski, Cortez Masto’s spokesperson said Thursday. Rosen’s office said she is reviewing Kelesis’ nomination.

Kelesis did not immediately respond to a request for comment.

Had Chattah’s appointment as interim expired in July, Nevada’s U.S. district judges would have been empowered to appoint her or a replacement.

In September, Campbell granted defense motions to disqualify Chattah’s supervision of four felony cases brought by her office after her term as interim U.S. attorney expired.

Campbell issued an order stating the Vacancies Reform Act “is a carefully crafted assertion” of Congressional power. “Its purpose would be defeated if the Executive Branch – the very branch Congress was trying to constrain – could choose whomever it wanted, whenever it wanted, and fill the vacancy simply by declaring that person to be first assistant.”

Campbell did not dismiss the indictments.

Since then, Chattah has remained in charge of the office, bearing the title of first assistant U..S. attorney.

Tyler Lee, an appellate attorney for the Department of Justice, argued Thursday that Campbell “adopted an overly narrow and textual view” of the law in ruling a first assistant can serve as the acting official only if they were the first assistant at the time the vacancy occurred. Lee also asserted that Campbell incorrectly concluded that the Vacancies Reform Act prohibited Chattah from supervising the U.S. Attorney’s Office as first assistant.

“Isn’t the whole point (of the law) to prevent backfilling of vacancies by putting in somebody as the first assistant after the vacancy arises?” Judge Eric Miller, who was appointed to the court by Trump in 2019, asked Lee. She acknowledged the VRA “prescribed certain restrictions on when a nominee may also serve as the acting.”

Judge Stanley Blumenfeld, also a Trump appointee, questioned whether allowing Chattah to remain in the position without a Senate confirmation “would be an easy workaround” of the VRA.

The law creates “an automatic default rule” that the person serving as first assistant at the moment the vacancy occurs becomes the acting officer “without any need for Executive Branch involvement,” Nevada Public Defender Jeremy Baron argued. “The provision does not allow the government to wait until months after the vacancy occurs, choose anyone in the country, hire them into the agency, back fill them into the first assistant position, and therefore make anyone in the country the acting officer.”

James Pierce, representing the Nevada Attorneys for Criminal Justice, echoed Baron, adding “any purported delegation from the Attorney General” conflicts with the VRA.

SACRAMENTO — A teen-age baseball star who was shot in the head along Interstate 80 three weeks ago during rush hour by her jealous baseball league coach has left the hospital and returned home.

Susanna Jacobs, 16, told the Sacramento Bee that the last thing she remembers about the Aug. 10 attack is jumping out of her coach’s pickup truck at 55 m.p.h. after he showed her a gun and said he was going to kill her.

Jacobs said her baseball coach and friend of six years, Jesse Aguilar, resented her friendship with another teen-age girl.

The star North Highlands pitcher, who played both softball and baseball, told the Bee that she was riding in Aguilar’s truck when he said: “Susanna, I don’t want you hanging around your best friend anymore.”

“Why?” she asked.

“Because I want you hanging around with me.”

“Why you got to be like that?”

“Susanna, I’m going to kill you.”

She said Aguilar showed her a gun and she leaped out of his truck. The next thing she remembers is waking up in UC Davis Medical Center, which she left Thursday.

Jacobs said she has no memory of hitting the ground or seeing the drivers who stopped to help her. She does not remember how Aguilar stopped, pushed his way through the crowd, and shot her in the head.

Aguilar, 42, then turned the gun on himself as two law enforcement officers in the crowd watched helplessly. He died instantly.

Doctors removed a bullet from beneath Jacobs’ brain and sealed her left ear canal. Later they operated again to remove a bullet fragment pressing on a nerve. She is permanently deaf in her left ear and has minor problems with short-term memory.

She cannot smile with the left side of her face or open her mouth more than a quarter of an inch. Light hurts her eyes and she takes heavy doses of painkillers.

Family and friends are raising money to pay her medical expenses.

Jacobs told the Bee that she will resume training for next year’s softball season during her recovery, adding, “There’s nothing that they’re stopping me from doing.”

Defendant further testified regarding his background as follows: He is a Palestinian Arab. He was born in 1944 in New Jerusalem, and in 1948 he and his family moved to Old Jerusalem where they remained until coming to the United States in 1956. Throughout his eight years in Old Jerusalem there were intermittent bombings. He attended school there. His family lived under poor conditions in Old Jerusalem [e.g., the whole family resided in one room with grossly inadequate toilet facilities]. He was told they were living as they were because "The Jews kicked us out of our home." He was also told of a massacre in which 250 people including children were slaughtered in cold blood by the Jews. While living in Old Jerusalem he went to a well for some water, and when the bucket came up it contained a hand and it sickened him. On one occasion he saw the exploded remains of a grocer he knew. In 1956 he heard about aggression by Israel against the Arabs in the Suez Canal. About a year after they came to the United States his father returned to Jordan. In 1963 defendant graduated from high school and subsequently attended college but was dismissed in 1965 after missing classes. He thereafter worked with horses but left his job in 1966 and did not find another job for a year. He read everything available on the Arab-Israel conflict and on the occult, in which he became interested in 1965. He joined the Rosicrucian Order in 1965. He performed several experiments such as concentrating on a mirror and seeing the face of Robert Kennedy instead of his own.

This book, for me, Robert W. Wildman II, began at a time when, for some rather unique geographic and personal reasons, I found myself unable to continue with a long-term scientific project in which I had been engaged. Looking for some scientific/literary contribution I might make under those circumstances, I found myself frequently visiting the psychology section of a bookstore in a mall near where I was temporarily residing. A review of the shelves of ?pop? psychology books revealed to me two things. First, all of the authors had and gave ?the answer,? typically a rather simple and unitary answer, to the emotional and mental problems of the reader. And second, all of these answers were different! Well, it just so happens that I received my clinical training at Georgia State University in the early seventies. While there, I went through all three of the major training programs. These were the psychotherapy training program, the behavior modification sequence, and the marriage and family program. There were also, I would add just for the sake of completeness, courses on psychological testing. Anyone at all familiar with the different schools of psychology will recognize that being exposed to such radically different ways of looking at mental problems and the even more radically different ways of going about trying to deal with them, all at the same time, would be a truly mind-blowing experience for a young graduate student. And it was! For various reasons, I feel fortunate to have survived.
